By placing an order with ByteCube Hosting, in sole agreement upon submitting a transaction (once you press the 'Pay Now' button when using PayPal for example, or once a transaction is complete) and tick the agreement confirmation checkbox if applicable, you confirm that you are bound in agreement to the terms and conditions written below:
GENERAL TERMS & CONDITIONS
ByteCube Hosting is registered private limited company, under the name "ByteCube Hosting Ltd" (Company Number: 10586376).
The companies director is Mitchell Welch, and owned solely by him, with no intention to transfer ownership without clear consent or accept responsibility for any impersonation taking place regarding us or any of our staff. It is your responsibility to make sure you are at 'bytecubehosting.com' or 'www.bytecubehosting.com' for manual fraudulent checking so please check your address bar regularly. We strongly recommend you to use our SSL site 'https://www.bytecubehosting.com'. It is also your responsibility to ensure e-mails and other sorts of communication are made ONLY through the methods shown on the support page of our site.
Our security method is trusted with a DDoS mitigation and protection feature, related to any sorts of large attacks from many sources. It is setup to saturate uploads from many sources within a time frame, then eventually block the sources. However, we are not responsible for any damage to your server or services, and we do not provide free backups of our services. Critical data of such should be kept in customers' safety for easy accessibility of having a backup of your service. Automatic backups can be provided with our services for an extra cost. If we find that your service is sending/receiving abusive packets, your account and service(s) will be terminated and your ISP may be notified. Any received attacks that are not properly taken care of by the customer, which are affecting our services, will also have to be suspended temporarily or terminated permanently.
The FTP Server is maintained by FileZilla, a highly secured and very lightweight server. For best use and compatibility, we recommend the FileZilla Client to connect to our FTP.
The VPSes we host are unmanaged, however they are monitored regularly in order to ensure good quality of services for our customers. The creation of more than one user account per VPS or service is prohibited unless permission given otherwise.
All interactive chat web applications are not allowed to be hosted on our web hosting plans, you are however authorised to use such applications pre-hosted but not on the web hosting server. This includes but is not limited to chat applications written in PHP, Perl, CGI, Python, Ruby, etc. in addition to IRC or IRC bots. Any web application that provides 'real-time' chat is not permitted. Shoutboxes, chatboxes, live chat/live help (such as but not limited to LiveZilla) and other web based chat programs are prohibited. Such terms are put into place due to these applications being more prone to easily going over any fair usage limits. Such applications will automatically be blocked by our servers if detected, and a possible suspension of service if found to be bypassing these automated detections or for multiple infringements. Web hosting plans are not for storage of data such as archives, music or videos and should only be used for website hosting content.
This genuine host accepts a 7 day money-back guarantee, within reason. If you are not satisfied we may ask for your opinion on improving our services, or assure you of our true services that you may not have experienced, in case one has misunderstood or became frustrated. We may also use any non-personal information given through any communication method or dispute for training purposes, to help improve our support of hosting and other future purposes.
The decision to whether you are eligible to a refund is always down to the staff of ByteCube Hosting.
The customer is responsible for the understanding of a properly described service, and the necessity of a service. Funds are held with us until a professional agreement is made with the outcome of the refund and/or request.
A surcharge (processing fee) of 7% will be deducted from all refunds and transactions sent from us to a customer as per PayPal fees (if applicable), setup fees and other charges that may have been obtained during the handling and funding of the mentioned service.
Please note that Renewals, VPSes, Pre-installed services, Web Hosting services, Exchanged services, Domain names, Dedicated servers/machines, Backups and/or any of the hosting addons/plan-upgrades are non-refundable. This is due to the funds being forwarded for promotional reasons, licenses, IP rental and other sorts of additions used within your process that are funded by the customer.
If any payment required from a customer is not received by the due date, we acquire the full right to terminate your service and gain a lock of access to any service until it has been renewed or extended, therefore leaving the decision down to us whether content will be kept within a time period.
We are entitled to recover (on a full indemnity basis) any costs and charges (including legal costs) incurred in recovering any amounts owed by you to ByteCube Hosting.
You acknowledge that should we not receive renewal payment prior to the date of expiry we reserve the right to suspend services immediately without notice. We may provide a 5 day grace period whereby we will hold your information and data on our servers, but should this period expire without payment we reserve the right to purge all data pertaining to your account with us.
Any interlinking services, such as Domains linked to Web Hosting, will be held by us until renewal or a relevant service has been purchased, as an interlinked service no longer belongs to a customer after expiration.
All payment methods shown on the footer of every page of our site are responsible for any errors in transaction and are absolutely out of our control. If you have an issue with a payment, it is recommended that you contact the payment provider for support. By default PayPal is a recommended method which accepts cards (without needing to sign up).
All payments are a one-off unless described otherwise (subscriptions, contracts, etc) but we do not possess the ability to process transactions without access to the payment account itself. We will therefore not be responsible for any automated payments (subscriptions, contracts, etc) that are left unattended as we do not control such activity. Ensure you contact your payment provider to cancel or suspend any automated payments as renewals are strictly non-refundable (See 'Refunds')
We might have, from time to time, to perform maintenance, upgrades or replacements of any hardware/software or content to our services and machines. We reserve the right to suspend access to any service during the required time to perform maintenance, upgrade or exchange the server, allowing us to quickly and safely finish the maintenance without any interruption or interference of a running service. Maintenance usually lasts no longer than 48 hours.
We provide a Service Level Agreement ("SLA") that includes a 100% uptime guarantee and a 4 hour grace period. If at any time any of your services are affected by downtime, and this period of downtime is less than 4 hours, you will not be entitled to any compensation. If the period extends further than 4 hours, you are entitled compensation. For every hour of downtime your service experiences, after the 4 hour grace period, you will be entitled to one day extra service for your service. This compensation has a limit of 14 days. If your service is offline for more than 18 consecutive hours, you will be entitled to no more than 14 days extra service. This is added to your billing due date upon contacting us. You must contact us to claim any compensation. If you put in a request for compensation, it will be validated by a member of our staff team, and once the validation stage has been completed the compensation will be awarded to your service.
This compensation is not applicable to any scheduled maintenance.
In this event, customers will be informed via e-mail of any planned maintenance. Any unplanned/planned maintenance will be posted on our Facebook page.
It is our responsibility to ensure that any applied hosting package application is completed and activated ready for full use. After completion, all our services are unmanaged unless agreed that managed support will be given. We will not be responsible for any misconfigurations or loss of data due to unauthorised exposure or accidental damage. Re-installations and re-services can be quoted by contacting us for a fee. Quoted times for account activation are estimates and we do not guarantee or imply activation within the quoted time frame. We may delay or refuse activation if:
- Payment is not cleared or received in full,
- We believe the order, information or payment is fraudulent,
- You have any funds outstanding with relation to any other account,
- There is any other reason which we deem unsatisfactory to our terms or beliefs, in which case we would explain within reason to you as soon as possible.
TERMINATION AND SUSPENSION
You may request to have your hosting terminated (cancelled) at any time by advising us via a method of contact on our site. We will only process a refund if we find it is applicable to the state of your current service(s) with us.
We may suspend any or all of your services where we have reason to suspect a violation of our terms and conditions whilst we investigate the suspected violation. We may also suspend your services where we have reason to suspect any type of illegitimate activity including, but not limited to, overdue invoices (lack of payment on any invoice without a notification of cancellation), copyright infringement, payment reversals, unfair usage and services affecting other customers or users on our servers. We reserve the full right to suspend a service at any time with the decision of its final status. You may also be charged an overdue/outstanding 'non-cancellation' fee for any suspended services that do not have a written cancellation logged.
If a customer violates our terms and conditions we may terminate or suspend (temporarily or indefinitely) any services you have with us. In this case no refund will be given for any payments that have been, or are made, by the transactor to us.
CHANGES TO OUR TERMS
If we decide to change our terms, we will update accordingly along with the modification date below. We reserve the full right to make changes to our Terms & Conditions at any time, you also agree that all changes made to the terms are taken place immediately, without notification needed, towards all services.
